Victorian Terror Laws Under Review Following Brighton Siege

Suspects who have never been convicted of a terrorism offence will be among those targeted in a state government overhaul of terror laws.

An expert panel led by former Victorian chief commissioner Ken Lay and former Court of Appeals judge David Harper will conduct a "root and branch" review of the current laws to prevent, investigate, monitor and respond to acts of terror, in the wake of criticism by Prime Minister Malcolm Turnbull and Melbourne's Brighton terror siege.

Announcing the panel on Sunday, Victorian Premier Daniel Andrews said "nothing is off the table".

It will also provide advice on removing any barriers to Victoria Police in responding to terrorist acts.

'If kerbing the rights of a small number of people is what's required to keep Victorians safe then I won't hesitate to do it, ' Mr Andrews told reporters.

Shamefully, Mr Andrews failed to finalise the deal with Canberra before the ARI's June 30, 2016, deadline and it's now confirmed that Victoria has missed out.

"We are not looking to further radicalise anybody", he said.

The announcement comes just days after Fairfax Media revealed Victoria Police is set to gain extraordinary powers to search suspects as young as 14 years old without a warrant.


Online radicalisation, curfews and Global Positioning System tracking of terror suspects will also form part of the review.

Victorian Premier Daniel Andrews said: "Nothing is off the table".

"Not everybody who poses a threat or a risk in fact has a terrorism conviction", he said.

"Not everybody who poses a risk is necessarily posing an imminent risk".

The panel's report will help form the state's proposals at a special COAG meeting to discuss a national approach to the issue.

Terror suspects could be placed under curfew, face Global Positioning System tracking and children as young as 14 could be locked up without charge under proposed hard-line reforms to Victoria's terror laws.

Greens MP Colleen Hartland said the review should work with the communities it will most affect.

Mr Harper said he would examine relevant precedents in terror legislation in both Australia and overseas.
